Building Facade & Code Compliance Project

Why Can't The La Vita HOA Wash the Windows?

  After 19 years of use and original design, Cal-OSHA (California Occupational Safety and Health Administration) issued a directive prohibiting use of the window washing equipment. The Association is not allowed to legally use the equipment and is required to create a code compliant design, bring the building equipment up to code, create a certified OPOS (Operating Procedures Outline Sheet) and obtain approval from Cal-OSHA.

Is There More to the Project Than Window Washing?

Yes. Cal-OSHA inspected the entire building for occupational safety hazards, and the Association is legally required to bring the community’s common areas into compliance. This includes modifying rooftop equipment and installing railings on the roof and on the courtyard planters. These requirements are included in the design documents.

Timeline of Project

  •   December 2022: The Olympique Façade Access Consulting contract was approved by the HOA Board and sent to Legal Counsel for review. 
  • January – November 2023: Ongoing discussions/negotiations with CalOSHA, Olympique, and Legal Counsel regarding issues including a load test being completed to generate structural calculations and railings to be required for common area planters over 30" tall.
  • December 2023: Olympique completed the design for the building, and it was sent to CalOSHA for review.
  • June 2024: The Association’s Legal Counsel drafted an agreement for the (12) homeowners that would be affected by the required building façade equipment. All (12) homeowners and the HOA Board started the process to sign, notarize, and record each agreement. 
  • November 2024: The Lynn Safety Company contract was approved by the HOA Board and sent to Legal Counsel for review. 
  • June 2025: The Association received all signed agreements by the (12) homeowners that would be affected by the equipment, and they were turned over to Legal Counsel for recording with the City of San Diego. 
  • September 2025: The Lynn Safety Company submitted plans for new building facade equipment to the City for review and permitting.
  • December 2025: The City requested additional plans to include the existing electrical components of the building.
  • January 2026: The City rejected the first set of plans and required an electrical engineer draft a set of plans for the existing electrical components not included in the original building plans. The Association’s vendor did not have an in-house electrical engineer and hired a third-party electrical engineer to draft the plans to meet the City’s concerns from the second review. 
  • March 2026: The Association received a draft copy of the OPOS for review. 
  • June 2026: The Lynn Safety Company & HOA met with the City prior to submitting the electrical plans for review and approval. The Lynn Safety Company is now additionally required to show stamped documentation that the equipment being fabricated for the exterior of the building is structurally compatible. The City is also requiring additional calculations and stamping of plans from D.H. Charles Engineering who already provided documentation in 2022 that both buildings can adequately support the equipment. The Association may be required to hire D.H. Charles Engineering again to comply with these new requirements from the City. 
  • July 2026: Olympique met with the City to address their concerns and explained that the document submitted should have sufficed to show the building’s structural integrity. The City continued to disagree and is requiring the additional measures and calculations be completed before they sign off on any plans and provide permits for new building facade equipment. Olympique and Lynn Safety Company are contacting D.H. Charles Engineering for a cost estimate to complete the measures and calculations required by the City.

  • Fabricate, Install, & Test New Building Façade Equipment
  • Finalize & Approve OPOS
  • Obtain Cal-OSHA Approval
